Bereavement and Probate Guidance

Bereavement Support & Probate Guidance

Losing a loved one can be overwhelming — emotionally and administratively. We’ve created this page to help you understand what steps need to be taken after a death, what probate involves, and how a Will can simplify the process for those left behind.

1. What To Do First After a Death

  • Contact the deceased’s GP or hospital to confirm the death and obtain a Medical Certificate.
  • Register the death at your local register office within 5 days.

  • Use the Tell Us Once service to notify most government departments.

  • Gather important documents such as the Will, death certificate, and financial details.

2. What Is Probate?

Probate is the legal process of dealing with someone’s estate — their money, property and possessions — after they die. It involves:

  • Confirming the Will is valid (if one exists)
  • Appointing the executors or administrators
  • Valuing the estate and paying any taxes due
  • Distributing assets according to the Will or intestacy rules

3. If There Is No Will (Dying Intestate)

If someone dies without a valid Will, their estate is shared according to strict rules. These may not reflect their personal wishes, and the process can be slower and more expensive.

  • No named executors — administrators must apply to manage the estate
  • No guidance on who should receive personal or sentimental items
  • Unmarried partners and stepchildren have no automatic rights

4. Bereavement Support Payment

If your spouse or civil partner has died, you may be entitled to financial support from the government, even if you’re working.

5. How a Will Helps

  • Simplifies the probate process with clear instructions
  • Speeds up access to funds and property
  • Reduces stress and family conflict
  • Names guardians for children and preferences for funeral arrangements
